FENCE RULES – SARASOTA (COUNTY), FLORIDA
OVERVIEW
Residential fences are permitted on private property within Sarasota County, subject to local regulations.
This page applies to properties in the unincorporated areas of Sarasota County; incorporated municipalities regulate fences under their own ordinances.

GOVERNANCE
Sarasota County regulates residential fences through the Sarasota County Code of Ordinances and the Unified Development Code. The principal fence section is UDC Section 124-125, Fences and Walls.
Sarasota County Planning and Development Services administers building, zoning, permitting, licensing, and enforcement functions. Sarasota County Zoning oversees the Unified Development Code for unincorporated Sarasota County.
Sarasota County publishes a dedicated UDC section for fences and walls rather than a separate homeowner fence ordinance. Fence rules are supported by administrative building permit guidance, zoning FAQ materials, and complaint-based code enforcement.
PERMIT AND APPROVAL REQUIREMENTS
• Standard Residential Fences: Chain link, wood, or vinyl fences on residential properties may be constructed without a Building Permit when they meet the standards in UDC Section 124-125, including height, placement, and finished-side requirements.
• Other Fences and Walls: The UDC states that all other fences and walls, including subdivision walls, require a Building Permit. Walls in the Siesta Key Overlay District are subject to UDC Section 124-102(b)(4) and require a Building Permit.
• Motorized or Electric-Powered Gates: Sarasota County’s Building Permit Guidelines list motorized or electric-powered gates as work requiring a Building Permit.
• Flood Zone or Larger Project Scope: Sarasota County’s Building Permit Guidelines state that no-permit examples may require a Building Permit when a building or structure is in a flood zone or when the listed work item is part of a larger project scope.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Sarasota County Zoning before construction.
• Variances: Variance requests from UDC standards are heard by the Board of Zoning Appeals through a public hearing process.
FENCE PLACEMENT RULES
• Side and Rear Yard Placement: The UDC lists a 0-foot minimum average setback for fences and walls in side and rear yards, with a maximum height of 8 feet.
• Property Line Placement: Sarasota County’s zoning FAQ states that residential fences may be installed up to the property line. Fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.
• Street Yard Placement: Street-yard fence height depends on the fence’s average setback from the right-of-way or property line. A street-yard fence set back less than an average of 4 feet is limited to 4 feet in height.
• Finished Side: The finished side of all walls and fences must face the street and adjacent properties.
• Right-of-Way Visibility: No fence may obstruct visual clearance along a right-of-way.
• Drainage: No fence or hedge may be constructed or installed in a manner that interferes with drainage on the parcel.
• Gate Swing: The code materials reviewed do not specify a separate gate-swing standard for standard residential fences.
• Utility Safety: Florida law requires notice through Sunshine 811 before excavation or demolition. For fence projects that involve digging, including fence post holes, notice generally must be given at least 2 full business days before excavation begins on land.
FENCE HEIGHT AND VISIBILITY RULES
• Street Yard, Less Than 4-Foot Average Setback: The maximum fence or wall height is 4 feet.
• Street Yard Along Significant Local, Collector, or Arterial Roads: With a 4-foot minimum average setback, the maximum fence or wall height is 8 feet.
• Street Yard Along Other Roads: With a 4-foot minimum average setback, the maximum fence or wall height is 6 feet.
• Side or Rear Yard: The maximum fence or wall height is 8 feet.
• Measurement: Fence and wall height is measured from the finished grade on either side of the wall or fence.
• Decorative Elements: Ornamental decorations and light fixtures on pillars or supports may extend up to 18 inches above the applicable maximum height.
• Siesta Key Overlay Corner Lots: In the Siesta Key Overlay District, on any corner lot in any zoning district, no fence, wall, hedge, or other planting that obstructs vision over 2.5 feet may be erected, placed, or maintained within the clear sight triangle.
MATERIAL AND CONSTRUCTION LIMITS
• Barbed Wire: Barbed wire and materials of similar character are prohibited, except as required by other ordinances or where used by lawful agricultural uses.
• Chain Link: Chain-link fences are prohibited in required front yards and in any required yard facing a public right-of-way.
• Wood Fencing: Wood fencing must be constructed using new decay-resistant or pressure-treated material.
• Masonry or Similar Hard Surfaces: Masonry or similar hard surfaces must have a decorative finish such as stucco and must be painted.
• Maintenance: All walls and fences must be maintained in sound condition and good repair.
• Landscaping for Fences Over 4 Feet: For any fence or wall on an individual residential lot in excess of 4 feet in height, the property owner must landscape the area between the street side of the wall or fence and the right-of-way line.
• Landscape Opacity: Required landscaping must provide at least 50 percent opacity within 5 years of planting and must be maintained at 50 percent or greater opacity after that.
• Minimum Landscape Material: Required landscaping must include at least 3 shrubs, 20 inches in height in a minimum 3-gallon container size, for each 15 linear feet of wall or fence. Alternative plant material providing equivalent opacity may be used with approval of the Administrator.
• Temporary Fences: Vinyl-coated chain-link fences may be erected to surround vacant lots or buildings on a temporary basis for a period not to exceed 1 year, subject to removal before issuance of a Certificate of Occupancy for a principal permitted use on the property.
PRIVATE RESTRICTIONS
Private deed restrictions, subdivision covenants, and HOA rules operate independently from Sarasota County fence regulations.
An HOA or private covenant may impose fence limits that are more restrictive than Sarasota County’s public rules, including limits on height, location, color, material, style, or approval process.
REVIEW AND ENFORCEMENT CONTEXT
Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:
• Permit-Required Work: Other fences and walls, subdivision walls, walls in the Siesta Key Overlay District, and motorized or electric-powered gates may be reviewed through the Building Permit process.
• Residential Fence Standards: Chain link, wood, or vinyl residential fences that do not meet height, placement, finished-side, material, landscaping, drainage, or visibility standards may be reviewed under UDC Section 124-125.
• Visibility and Drainage: Fences that obstruct right-of-way visual clearance or interfere with parcel drainage are identified in the UDC as regulated conditions.
• Code Enforcement: Sarasota County Code Enforcement reviews zoning code issues in unincorporated Sarasota County through complaint-based enforcement.
• Building Licensing and Enforcement: Sarasota County Building Licensing and Enforcement investigates unpermitted construction work and related building enforcement issues.
