FENCE RULES – SARASOTA (CITY), FLORIDA

OVERVIEW

Residential fences are permitted on private property within City of Sarasota, subject to local regulations.

City of Sarasota fence standards appear primarily in the City of Sarasota Zoning Code, Article VII, Division 11, Fences and Walls and Hedges. GOVERNANCE

The governing authority is the City of Sarasota, acting through the City Commission and administered through Development Services, including Building & Permitting, Zoning, and Code Compliance.

The city does not publish a single consolidated residential fence handbook. Fence rules are divided among the City of Sarasota Zoning Code, especially § VII-1101, related visibility references in § VII-1203, building-permit guidance, and Building & Zoning Division fence and wall submittal instructions.

PERMIT AND APPROVAL REQUIREMENTS

Fence/Wall Permit Application: The Building & Zoning Division publishes minimum plan requirements for fences and walls and requires a completed application as part of the permit application submittal for residential fence or wall installation.

Residential Fence/Wall Submittals: The published submittal materials require five copies of a survey for a residential fence or wall and five sets of construction drawings. The survey must show lot lines, street names, north arrow, proposed fence or wall location, applicable dimensions, and pool or spa location if applicable. The construction drawings must show cross-section, structural material, height above existing grade, penetration below grade, masonry wall footing and rebar if applicable, and electrical schematic if applicable.

Permit Scope: The Building Division states that issuance of a Building Permit is not a license to exceed the scope of work listed on the permit application. Any change to the scope of work must first be approved by the Building Official, and the permit scope must be corrected.

Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with City of Sarasota Zoning before construction.

Pool Barriers: If a fence is intended to serve as a swimming pool safety barrier, the city’s fence inspection materials apply pool-barrier requirements in addition to standard fence rules.

FENCE PLACEMENT RULES

Setbacks: Fences and walls up to 6.5 feet in height are permitted in front, rear, and side setbacks in all zone districts, unless a listed exception applies.

Property Lines: The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Waterfront Setbacks: Solid fences, walls, hedges, or other landscaping materials that form a continuous barrier are limited to 30 inches in waterfront setbacks. Picket fences with minimum 1.75-inch spacing and pickets no more than 4 inches wide are permitted. Open mesh or chain-link fences up to 48 inches are permitted.

Lido Shores Thoroughfare Lots: On properties in the Lido Shores neighborhood with property lines abutting a thoroughfare road, a qualifying solid opaque fence, wall, or hedge must be outside the public right-of-way and must be set back at least 20 feet from the edge of pavement.

Lido Shores Landscaping: If a fence or wall is erected under the Lido Shores thoroughfare-lot rule, the property owner must landscape the area outside the right-of-way under a city-approved landscaping plan and must maintain that landscaping under city standards.

Emergency Access: No fence, wall, or hedge may be erected so as to restrict access by emergency equipment to any building.

Fire Hydrants and Water Supply Connections: Fire hydrants and connections to approved water supplies must remain accessible to the fire department. The published clearance standard is 7.5 feet in front and to the sides of a fire hydrant, with 4 feet to the rear, unless reduced by approval of the fire official.

Utility Safety: Florida law requires notice through Sunshine 811 before excavation or demolition. For fence projects that involve digging, including fence post holes, notice generally must be given at least 2 full business days before excavation begins on land.

FENCE HEIGHT AND VISIBILITY RULES

Standard Fence and Wall Height: Fences and walls up to a maximum of 6.5 feet in height are permitted in front, rear, and side setbacks in all zone districts, except where a specific exception applies.

Hedges: Hedges up to 6.5 feet in height are permitted in the front setback in all zone districts, except where a specific exception applies. Hedges in rear and side setbacks are not limited in height, except where a specific exception applies.

DTN Zone District: In the DTN zone district, fences and hedges at the first layer of a lot may not exceed 4 feet in height. Fences and walls at other layers may not exceed 6.5 feet in height.

RSM-9 Zone District: In the RSM-9 zone district, fences, walls, or hedges located between the front facade of the primary building and the front lot line may not exceed 4 feet in height.

Single-Family Interface: Fences and walls up to 8 feet in height are permitted in rear and side setbacks when multifamily or nonresidential zone districts abut single-family zone districts. The ordinance states that the fence or wall may be on either the multifamily, nonresidential, or single-family zoned property.

Lido Shores Thoroughfare Lots: On qualifying Lido Shores properties with property lines abutting a thoroughfare road, solid opaque fences, walls, and hedges up to 12 feet in height are permitted along those property lines. The fence, wall, or hedge may extend no more than 25 feet past the point where the property line no longer abuts the thoroughfare road.

Ornamental Features: Ornamental decorations and light fixtures not exceeding 18 inches above the maximum 6.5-foot height limit may be allowed on pillars or supports for a fence or wall.

Height Measurement: Fence and wall height is measured at the highest point above natural grade on either side of the fence or wall.

Sight Triangles: Fences, walls, and hedges must comply with the sight-triangle provisions in § VII-1203. The code cross-references Engineering Design Criteria Manual visibility standards, but the provided city materials do not publish a numeric sight-triangle distance in the fence section.

Pool Safety Fence Height: If a fence is intended to serve as a swimming pool safety fence, the minimum pool safety fence height is 48 inches.

MATERIAL AND CONSTRUCTION LIMITS

General Residential Materials: Outside the specific zone districts and special contexts listed below, the code does not publish a closed list of permitted materials for standard residential fences.

Prohibited Features: For standard residential fencing, razor wire, barbed wire, coiled barbed wire, and any fence or wall with an electric charge are not permitted.

Finished Side: The finished side of all fences must face the street or adjoining property. All walls must be finished on both sides.

DTN First Layer Materials: In the DTN zone district, first-layer fences must be wrought iron, aluminum, or painted or stained wood or simulated wood pickets, with at least 1.75 inches of spacing and pickets no more than 4 inches wide.

DTN Other Layer Materials: In the DTN zone district, fences and walls at other layers must be painted or stained wood or simulated wood, coated chain link, wrought iron, aluminum, or masonry finished on both sides.

Pool Safety Fence Construction: If a fence is used as a swimming pool safety barrier, access gates must swing away from the pool area, must be self-closing, and must be self-latching. The latch must be at least 54 inches from the bottom of the gate. Openings at the bottom of the fence may not exceed 2 inches from grade.

Pool Barrier Openings: For aluminum or wrought iron pool safety fencing, where horizontal and vertical member rules apply, spacing between vertical members may not exceed 1.75 inches. For chain-link pool safety fencing, the maximum mesh size is 2.25 inches square, unless slats reduce the openings to no more than 1.75 inches.

PRIVATE RESTRICTIONS

Private covenants, homeowner association rules, neighborhood association requirements, and deed restrictions operate independently from City of Sarasota fence regulations and may be more restrictive.

City materials note that neighborhood associations may require compliance with their regulations before submission for a building permit application. Private restrictions do not reduce city requirements and do not authorize work that conflicts with city code.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

Fence/Wall Application Review: Residential fence or wall installation is reviewed through the Building & Zoning Division application and submittal process when a fence or wall permit application is submitted.

Residential Survey and Construction Drawings: Review may include the required survey showing proposed fence or wall location and dimensions, and construction drawings showing materials, height, below-grade penetration, and applicable wall or electrical details.

Permit Scope: Work outside the approved permit scope requires approval by the Building Official and correction of the permit scope.

Height and District Limits: Fence, wall, and hedge height may be reviewed against the 6.5-foot standard limit and the specific DTN, RSM-9, waterfront setback, single-family adjacency, and Lido Shores rules.

Visibility: Fences, walls, and hedges may be reviewed for consistency with the sight-triangle provisions cross-referenced in § VII-1203.

Rights-of-Way and Easements: Fence placement may be reviewed for encroachments into rights-of-way, easements, or required access areas.

Emergency and Fire Access: Fences, walls, and hedges may be reviewed where they restrict emergency equipment access, fire hydrant clearance, or access to approved water supply connections.

Materials and Construction: Review may include prohibited electric fencing, barbed or razor wire, finished-side orientation, wall finishing, and swimming pool safety fence requirements.

Code Compliance: Code Compliance investigates complaints and reported code violations, including reported unpermitted work.
