FENCE RULES – JUPITER (TOWN), FLORIDA

GOVERNANCE
• Governing Authority: The Town of Jupiter regulates residential fences through the Code of the Town of Jupiter, Florida, primarily in Chapter 27, Zoning.
• Building Review: The Town of Jupiter Building Department administers building permits and plan review for building permit applications.
• Zoning Review: The Department of Planning and Zoning administers planning, zoning, historic preservation programs, the comprehensive plan, and related land development functions.

PERMIT AND APPROVAL REQUIREMENTS
• Building Permit: A Building Permit is required for a standard residential fence. The Town’s zoning fence sections state that fences and walls enclosing a permitted use must comply with the Town’s building permit procedures, and the Town’s published common code violations materials state that permits are required for fences.
• Approved Plans: The Town’s fence certification form requires certification that fence construction or replacement will be installed in accordance with the current Town ordinance and the approved plans for fences.
• Zoning Compliance: Building permit requirements are separate from zoning, setback, or plat requirements. Confirm any applicable zoning conditions, setbacks, and plat requirements with Department of Planning and Zoning before construction.
• Historic Structures and Walls: For a locally designated historic structure, the Town’s Certificate of Appropriateness process applies to listed exterior changes. The published process places material changes to existing walls and construction of new walls under Special Certificate of Appropriateness review by the Historic Resources Board.
FENCE PLACEMENT RULES
• Side and Rear Yard Lot Lines: On residentially zoned property, fences and walls may be erected or maintained along or adjacent to a lot line in the required side and rear yards, subject to the 6-foot height limit.
• Front Yard Area: Fences, walls and hedges in the front yard area of a residential district are limited to 4 feet in height.
• Setbacks and PUD Rules: The Town’s Planning & Zoning FAQ states that setbacks may be determined by approved PUD rules or by the underlying zoning district. The fence section separately allows residential fences and walls along or adjacent to lot lines in required side and rear yards, subject to the applicable height limits.
• Corner Visibility Area: Within the visibility area formed by intersecting street right-of-way lines and a line connecting points 25 feet along those right-of-way lines, fences, walls, hedges and vision-obstructing plantings are limited to 2½ feet or less.
• Easements: The Planning & Zoning FAQ states that easements may affect how land can be used and whether building over them is allowed. A utility easement is identified as a common example.
• Utility Safety: Florida law requires notice through Sunshine 811 before excavation or demolition. For fence projects that involve digging, including fence post holes, notice generally must be given at least 2 full business days before excavation begins on land.
FENCE HEIGHT AND VISIBILITY RULES
• Side and Rear Yards: On residentially zoned property, fences and walls in required side and rear yards may not exceed 6 feet in height.
• Front Yard Area: Fences, walls and hedges in the front yard area of any residential district may not exceed 4 feet in height.
• Corner Visibility: In the required intersection visibility area, fences, walls, hedges and vision-obstructing plantings may not exceed 2½ feet above the average grade of each street, measured at the street centerlines.
• Hedges: Hedges may be planted or maintained along or adjacent to rear, side corner and side yard lot lines, provided the hedge does not exceed 8 feet.
MATERIAL AND CONSTRUCTION LIMITS
• Injury-Causing Materials: Walls, fences, hedges and similar barriers or enclosures in residential districts must not contain substances such as broken glass, spikes, nails, or similar materials designed to inflict pain or injury to a person or animal. One residential fence section also names razors.
• Fence and Wall Maintenance: The Town identifies fence and wall maintenance as a common code issue. Fences and free-standing walls must be maintained in good repair and free of material defects, including leaning, discoloration, rips, holes, tears, missing slats, cracks, breaks and rotted material.
• Additional Residential Materials: The code sections reviewed do not specify a general list of approved residential fence materials for standard single-family fences.
PRIVATE RESTRICTIONS
• HOAs and Covenants: Private restrictions, including HOA rules, deed restrictions and recorded covenants, operate independently from Town fence regulations and may be more restrictive than the Town’s published standards.
• Private Review: A fence that satisfies Town permit, zoning and code requirements may still be subject to private architectural approval or private covenant limits.
